Yes, one parent must be a citizen at the time of birth for you to be natural-born (plus the birth must be on US soil-not sure how military bases are treated) Kamala was born to TWO foreign students in California. At the time of her birth she would have been given citizenship from her mother – INDIA. However, we can not find any records showing how Kamal claims to be a US citizen. Furthermore, the Supreme Court, early 1800s as I recall, clarified the eligibility of Presidents (and thus VPs), directly referencing the “law of nations”, as being a natural born citizen born of two natural born citizens, and the reasoning that a son’s loyalty would naturally follow his father’s. Try finding this decision today! It has been “erased”. I first read this decision in 2012 online and I recall it because it is where I first heard of the “law of nations”! (And, I was a paralegal for many years!)

It was never the intent of the writers to give citizenship to individuals based on where they were born. One must be “subject to the jurisdiction thereof”, the jurisdiction of the United States. This amendment was written to ensure children born of ex-slaves were given citizenship. At the same time it did not cover American Indian’s children due to the fact they were not considered citizens of the US. Neither of Kamala Harris’ parents were citizens at the time of her birth therefore she was not subject to the jurisdictions of the US.
